MP News: Election Of BJP MLA Rahulsinh Lodhi Void, High Court Orders On Congress's Chanda Gaur's Petition

Justice Nandita Dubey’s single bench of Madhya Pradesh High Court Singh Lodhi’s election has been made void. Instructions have been given to send a copy of the order to the Madhya Pradesh State Election Commission and the Election Commission of India. Along with the election being void, instructions have also been given to stop all the MLA related benefits being given to Lodhi. Please tell that the petition was filed on behalf of Chanda Singh Gaur, who was the defeated candidate on Congress ticket from Khargapur Assembly Constituency. In this, apart from accepting the nomination papers of the BJP MLA in an illegal manner by the Election Officer, it was alleged that he had hidden the information of partnership with a private contracting company contracted by the government. Not only this, the amount of Rs 1000 fine imposed on Lodhi by the High Court in the past 07 was also donated. Singh Gaur was also accused of non-payment. After listening to all the arguments, the High Court, in its order, made strong remarks about the election officer going beyond the ambit of the rules and approving the nomination. This attitude was termed as a violation of section- of the Representation of the People Act. It was alleged in the election petition on behalf of the election petitioner Chanda Singh Gaur that earlier when she was elected MLA Lodhi had filed an election petition against him, who was fined 134 thousand rupees. including was cancelled. Lodhi was supposed to pay this amount to Gaur in compliance with the High Court’s direction, but he did not do so. Since this attitude comes under the ambit of violation of Section-07 of the Representation of the People Act, therefore The election should be cancelled. Apart from this, two nomination papers were also submitted, in which mutually contradictory information was given. The mistake was made of completely hiding the information of partnership from the contracting company. ,
